Richard E. Spicer, a partner in Spicer Rudstrom’s Nashville office, is slated as a speaker in an upcoming webcast for the Association of Corporate Counsel (ACC). “Reptile Theory 2016: What In-House Counsel Need to Know Now” will take place at 11 a.m. CST on Thursday, Jan. 28. It is presented by the ACC’s Real Estate Committee and sponsored by the International Society of Primerus Law Firms.
This one-hour webcast will explain, in detail, how prosecutors are employing the “reptile theory” to make jurors believe the worst about a defendant, typically a company, and its record of safety by focusing on the discovery and trial of a case on the defendant’s behavior (rather than the traditional attempt to engender sympathy for the plaintiff). Rich and his co-presenter, Christian Stegmaier, a shareholder in the Columbia, S.C.-based firm Collins & Lacy, will outline updated strategies to effectively combat this technique from the creation of contracts and course of dealing issues to litigation of a claim (discovery to trial).

Rich represents insurance companies and their insureds, as well as self-insured companies in serious litigation involving construction law, premises liability, insurance law, product liability, automobile, and company trucking issues, and other complex litigation involving generally high-exposure claims. Rich is oftentimes retained to handle particularly unusual claims and litigation to also include complex and emotional wrongful death litigation.
