Thomas E. LeQuire recently secured a dismissal on a motion for summary judgment against their client, Bradley County. The case involved a motorcycle rider who slid on gravel at the intersection of a state highway and county road. The rider sustained minor injuries and totaled his custom motorcycle. He sued the county for injury caused by a dangerous condition of a street or highway owned and controlled by the county, pursuant to the Governmental Tort Liability Act (GTLA) statute.
Tom worked with the defendant to show it had no notice of any hazardous condition on the county portion of the intersection. Since the plaintiff was unable to show any evidence the county had notice of the condition, which is required by statute, the case was dismissed.
