Tom LeQuire Secures Important Win

Attorney Tom LeQuire secured victory for Spicer clients Bradley County Government and Officer Tammy Goodwin, regarding Federal and State Claims stemming from a police encounter. The case originated in State Court but was removed to Federal Court. On behalf of the clients, LeQuire asked the Federal Court to dismiss the Federal Claims against the County and Officer Goodwin on the basis of qualified immunity. LeQuire was able to prove to the Court that all of the elements necessary for qualified Immunity were present, and the Federal Claims were dismissed.

The State law claims against the County and Officer Goodwin were sent back to State Court. LeQuire moved for summary judgment on the State claims, asserting that the plaintiff was collaterally estopped from asserting the State claims because the issues had already been addressed in the Federal Court.
