Spicer Rudstrom attorney Brent S. Usery recently represented a property management company in a trip and fall case. The company and the landowner of a rented duplex were being sued by the plaintiff, who suffered serious injuries in a fall that required multiple surgeries. The suit was for $1,500,000.00. During mediation, Brent’s litigation strategy of leveraging the indemnification clause in the property management contract against the landowner caused the landowner to take the overwhelming majority of responsibility in the trip and fall. The case was then settled with the plaintiff.
